Welcome to BoardBay. These Terms of Service govern all use of our website and all purchases made through boardbay.store or through any other official BoardBay communication channels. By placing an order, the customer confirms acceptance of these Terms in full.
1. Company Information
BoardBay is operated by Bay Industries, a sole proprietorship registered in Belgium under VAT number BE1013024151, operating under the Belgian “small business” regime. As such, prices are not subject to VAT.

2. Scope and Applicability
These Terms of Service apply to all orders and sales between BoardBay and its customers, whether through the webshop or via custom communication (e.g. email or invoice). Any other terms or conditions provided by the customer are excluded unless explicitly agreed in writing by BoardBay.
3. Products and Availability
BoardBay designs and builds high-quality custom mechanical keyboards tailored to the customer’s preferences. A limited number of pre-built keyboards are also available for direct purchase.
Every keyboard is custom-built by BoardBay and is not a resale or off-the-shelf product. Product descriptions are carefully prepared, but small errors, omissions or inaccuracies may occur.
Photos and videos are illustrative and may not perfectly represent the final product in terms of color, sound or other aesthetic details.
4. Orders and Confirmations
Orders for in-stock keyboards are processed through the webshop. Custom orders may be arranged via email, invoice or any other communication method as agreed with the customer.
An order is considered binding once BoardBay confirms it via email or invoice. Customers are responsible for reviewing this confirmation and must notify BoardBay of any discrepancies. If no such notice is given, the confirmation is presumed to be correct.
5. Prices and Currency
All prices are stated in EUR unless explicitly stated otherwise. Prices are not subject to VAT under the Belgian small business exemption (Kleineondernemingsregeling).
Shipping costs for in-stock products are clearly visible in the shopping cart. For custom orders, full pricing including shipping will be communicated upfront.
Although BoardBay aims to ensure pricing is accurate, errors may occur. In such cases, BoardBay reserves the right to correct errors and inform the customer prior to proceeding with the order.
6. Payment
All products must be paid in full before shipment unless agreed otherwise. Accepted payment methods include Bancontact, PayPal, and credit cards. Custom orders paid via invoice must be paid under the agreed terms specified in the invoice.
BoardBay reserves the right to delay or refuse delivery until payment is confirmed.
7. Shipping and Delivery
BoardBay ships globally. For in-stock keyboards, orders are typically shipped within 1 to 2 business days.
Delivery time varies depending on the destination and shipping method, but is generally between 1 to 10 business days.
Shipping costs and customs duties are always borne by the customer. Shipping costs are shown clearly before checkout for in-stock products. For custom projects, shipping will be calculated and disclosed before payment.
8. Right of Withdrawal
Custom-built products are excluded from the right of withdrawal in accordance with European consumer law. Once a custom order is placed and confirmed, it is final and non-refundable.
In-stock (non-custom) products may be eligible for return under EU withdrawal rights. Customers must contact BoardBay to confirm eligibility before returning any item.
9. Warranty and After-Sales Support
BoardBay provides a 2-year statutory warranty on all products, covering defects resulting from normal use. Defective products within this period will be repaired free of charge.
Even after the warranty period, customers can reach out to BoardBay for professional repair services. Fees may apply depending on the nature of the issue.
Warranty does not apply to damage caused by misuse, neglect, modifications by the user, or external causes.
10. Complaints
Customers are required to inspect their product upon delivery. Complaints regarding visible damage or non-conformity must be reported within 14 calendar days of receipt, via support@boardbay.store or any of the methods listed on the contact page of the website.
If no complaint is received within this period, the product is considered accepted.
11. Intellectual Property
All content, media, designs and materials available on the BoardBay website are the intellectual property of BoardBay unless otherwise stated. Reproduction, distribution or commercial use without permission is strictly prohibited.
12. Electronic Communication and Evidence
The customer accepts that digital communications, including emails and electronic order records, may serve as legal evidence in case of disputes.
13. Changes to These Terms
BoardBay reserves the right to update these Terms of Service at any time. Material changes will be communicated clearly on the website. Continued use of the website or services after such changes constitutes acceptance of the updated terms.
14. Governing Law
These Terms are governed by the laws of Belgium. Any disputes will be handled in accordance with applicable Belgian legislation.
